{"id":23958,"date":"2013-06-11T17:00:01","date_gmt":"2013-06-11T21:00:01","guid":{"rendered":"https:\/\/bejsment.com\/?page_id=23958"},"modified":"2021-06-03T13:57:52","modified_gmt":"2021-06-03T17:57:52","slug":"terms-and-conditions-of-patatay","status":"publish","type":"page","link":"https:\/\/bejsment.com\/index.php\/terms-and-conditions-of-patatay\/","title":{"rendered":"Terms and conditions of Clascal"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">By accessing Clascal Network you are agreeing to the following terms:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You will not do any of the following bad things:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">violate any laws;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">be false or misleading;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">infringe any third-party right;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">distribute or contain spam, chain letters, or pyramid schemes;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">distribute viruses or any other technologies that may harm Clascal or the interests or property of Clascal users;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">copy, modify, or distribute any other person\u2019s content;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">use any robot, spider, scraper or other automated means to access Clascal and collect content for any purpose without our express written permission;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">harvest or otherwise collect information about others, including email addresses, without their consent;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">bypass measures used to prevent or restrict access to Clascal.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You understand and agree that the Service is provided \u201cAS-IS\u201d and that Clascal assumes no responsibility for information or settings or any input you provided.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Clascal has a right terminate your account and service without notice or explanation any time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Clascal if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Clascal or not, we do not accept any liability for monitoring Clascal or for unauthorized or unlawful content on Clascal or use of Clascal by users.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Canada or other applicable jurisdictions. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service\u2019s registration form (such information being the \u201cRegistration Data\u201d) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You agree that Registration Data and certain other information about you beside registration can be stored.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You agree that information about you can be used for advertising purpose.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You agree that your email will be added to newsletters of newspapers operating on Clascal system, and you agree to receive those newsletters.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You agree that you are taking full sole responsibility for all your activity on sites passed on Clascal system.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When you are posting your email on the site either by responding to classified or in any other place you automatically agree to receive newsletter form one or many sites operating on Clascal System.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You understand that all materials, including without limitation, information, data, text, software, music, sound, photographs, graphics, video, and email messages or other kinds of messages (\u201cContent\u201d), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Clascal, are entirely responsible for all Content that you upload, post, email, transmit, or otherwise make available via the Service. Clascal does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Clascal be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of or reliance upon any Content posted, emailed, transmitted, or otherwise made available via the Service.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN \u201cAS IS\u201d AND \u201cAS AVAILABLE\u201d BASIS. Clascal AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES, REPRESENTATIONS AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Clascal AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS, PARTNERS AND LICENSORS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Clascal OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">LIMITATION OF LIABILITY<\/span><\/p>\n<p><span style=\"font-weight: 400;\">YOU EXPRESSLY UNDERSTAND AND AGREE THAT Clascal AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF YAHOO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fees and Services.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Using Clascal is generally free. We may charge fees for certain services. If the service you use charges a fee, you\u2019ll be able to review and accept that charge. Our fees are non-refundable, and you are responsible for paying them when they\u2019re due. If you don\u2019t, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Content.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Clascal contains stuff from us, you, and other users. You agree not to copy, modify, or distribute Clascal, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. If you believe that your rights have been violated, please notify our designated copyright agent at Clascal Customer Support and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party\u2019s rights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">General.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These terms and the other policies posted on Clascal constitute the entire agreement between Clascal and you, superseding any prior agreements. This agreement is governed by the laws of Canada. We both submit to the non-exclusive jurisdiction of the courts of Toronto, Canada. This won\u2019t affect your statutory rights if you are a consumer and applicable consumer law requires application of another law (such as the law of your country of residence) for certain topics. If we don\u2019t enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This agreement was written in English (US).
